INFORMATION ON DATA SUBJECTS’ RIGHTS IN THE PROCESSING OF PERSONAL DATA

1.      OUR COMPANY, objectives OF THIS INFORMATION, AND PROCESSED PERSONAL DATA

1.1.  Company: IVIGEE Services, a.s., ID No.: 10725300, with its registered office at Hvězdova 1716/2b, Nusle, 140 00 Prague 4, hereby informs you of your rights in connection with the processing of your personal data by our company as the data controller or processor.

1.2.  Depending on the situation, we may process in particular your following personal data: identification data (name and surname, telephone number), address data (delivery address, billing address), identification data of your device (IP/MAC address), and contact details (telephone number, e-mail address).

2.      RIGHT TO INFORMATION

2.1.  We hereby provide you with the following information regarding the processing of your personal data, which may be supplemented as necessary at the time you provide us with your data:

2.1.1.     the identity and contact details of us as the data controller or processor and our representative, if any;

2.1.2.     the purposes of processing for which your personal data is intended and the legal basis for its processing;

2.1.3.     information about the legitimate interests of us as the controller or of a third party (where applicable);

2.1.4.     any recipients or categories of recipients of your personal data;

2.1.5.     where applicable, any intention on our part as the controller to transfer personal data to a third country or international organization and the existence or absence of a European Union Commission decision on adequate protection thereof;

2.1.6.     the period for which your personal data will be stored, or, if this cannot be determined, the criteria used to determine this period;

2.1.7.     the existence of the right to request from us as the controller access to personal data concerning you as a data subject, rectification or erasure, or restriction of processing, and to object to processing, as well as the right to data portability;

2.1.8.     if the processing is based on your consent, the existence of the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal;

2.1.9.     the existence of the right to lodge a complaint with a supervisory authority;

2.1.10.  whether the provision of personal data is a statutory or contractual requirement, or a requirement necessary to enter into a contract, and whether the data subject is obliged to provide the personal data and of the possible consequences of failure to provide such data;

2.1.11.  where applicable, the fact that automated decision-making, including profiling, takes place, and information related to the logic involved, significance and details of the automated process.

3.      RIGHT OF ACCESS TO PERSONAL DATA

3.1.  You have the right to obtain from us, as the controller, confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, you have the right to access the personal data and the following information:

3.1.1.     the purposes of the processing;

3.1.2.     the categories of personal data concerned;

3.1.3.     recipients or categories of recipients to whom your personal data have been or will be disclosed, in particular recipients in third countries or international organizations;

3.1.4.     the envisaged period for which your personal data will be stored, or if this cannot be determined, the criteria used to determine this period;

3.1.5.     the existence of the right to request from us, as the controller, the rectification or erasure of personal data concerning you as the data subject, or the restriction of processing, and to object to such processing;

3.1.6.     the right to lodge a complaint with a supervisory authority;

3.1.7.     all available information on the source of the personal data, if not obtained from you as the data subject;

3.1.8.     the fact that automated decision-making, including profiling, is taking place, including the procedure used and the consequences for you.

We will provide the first copy of the personal data processed free of charge. For further copies at your request as a data subject, we may charge a reasonable fee related to the administrative costs of handling your request.

4.      RIGHTA TO RECTIFICATION AND ERASURE

4.1.  You have the right to have us correct inaccurate personal data concerning you without undue delay. Taking into account the purposes of the processing, you have the right to have your incomplete personal data completed. You also have the right to have us erase personal data concerning you without undue delay, and we are obliged to erase such personal data without undue delay if one of the following reasons applies:

4.1.1.     your personal data are no longer necessary for the purposes for which they were collected or otherwise processed;

4.1.2.     you withdraw your consent on the basis of which your data were processed and there is no other legal reason for processing;

4.1.3.     you object to the processing of your personal data, which we process on the basis of our legitimate interest, and we are unable to demonstrate that our legitimate interest outweighs your rights and freedoms, in particular your right to privacy;

4.1.4.     there is another legal reason for the erasure of your personal data (e.g., compliance with a legal obligation);

4.1.5.     it turns out that we have processed your personal data unlawfully.

5.      Right to restriction of processing of personal data

5.1.  If you believe that the personal data we process are incorrect, you may request that we restrict their processing for the time necessary to verify their accuracy and, if necessary, correct them. You also have this right in the following cases:

5.1.1.     the processing of your personal data is unlawful, but you do not want us to delete your personal data;

5.1.2.     we no longer need your personal data for the purpose for which we processed them, but you insist on their processing (in particular storage) for the establishment, exercise, or defense of your legal claims;

5.1.3.     you have objected to the processing of your personal data on the basis of our legitimate interest; in this case, we will restrict the processing until we have assessed whether our legitimate interest outweighs your right to have your personal data no longer processed.

6.      Right to PORTABILITY

6.1.  If we process your personal data by automated means on the basis of your consent or the necessity for the performance of a contract, you may request that we provide you with your personal data in a structured, commonly used, and machine-readable format. You also have the right to request that we transfer your personal data in this format to another controller, if technically feasible.

7.      RIGHT TO OBJECT

7.1.  You have the right to object to the processing of your personal data in cases where we process your personal data for the purpose of performing a task carried out in the public interest or in the exercise of official authority, or where the processing is necessary for the purposes of the legitimate interests of us as the controller or a third party. If you subsequently object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for doing so. This objection may also be raised against the processing of your personal data for direct marketing or profiling purposes – your personal data will then no longer be processed for these purposes.

8.      RIGHT TO COMPLAIN

8.1.  You also have the option to lodge a complaint regarding the processing of your personal data by us as the controller directly with us or with the Office for Personal Data Protection available at https://uoou.gov.cz/verejnost/stiznost-na-spravce-nebo-zpracovatele.
